1.  HOW TO ENTER:

 

a. KyXy’s “Finish The Lyrics” contest will be conducted weekdays beginning Thursday, September 18 through Wednesday, October 15, 2008 at 7:00am, 11:00am and 3:00pm.

 

 

b. One entry per person, per household, regardless of the means of entry.  

 

a. Each hour, 7:00am, 11:00am and 3:00pm, listeners will be prompted to visit www.kyxy.com to see the hour’s “secret song” clue chosen by station management. They will be instructed to listen to KyXy 96.5 on the air during that entire hour for the KyXy personality to announce that’s it’s time to take the 9th caller who thinks they know the missing lyrics which follow the song segment KyXy management have chosen for that hour’s clue. The answer to the song lyric always appears as blanks on the clue page at www.kyxy.com in the exact amount of words which KyXy considers the correct answer. The clue song, title and artist of each hour’s contest song will be announced on-air at the time in which the the air personality solicits for the 9th caller and again when a contestant is selected to play the contest.  Listeners must call the KyXy studio line at 1-888-560-9650 to participate.  If the caller either speaks or sings the missing secret song clue words with the same words KyXy management have designated as the answer they are looking for, the contestant will win $100 cash and be qualified to win the grand prize

 

b. If the contestant responds with an answer that does not match the exact words KyXy is looking for, the contestant may continue to compete for additional chances at participation in other scheduled contest hours and days. One person per household may win a cash prize and qualifying grand prize during the stated length of this contest. If a secret song lyric clue is answered with different, additional or missing words from those KyXy is looking for, the correct answer is revealed on the air and a brand new secret song is selected and clue revealed on-line at www.kyxy.com at the top of the next scheduled contest hour. (20 days x 3 winners per day = 60 winner/grand prize qualifiers).

c. KyXy is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call.      KyXy is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.  Decision of KyXy On-Air personality on duty is final.

 

2.  ELIGIBILITY RESTRICTIONS

 

a.   The contest is open to all KyXy listeners who are 18 years of age or older and who reside in San Diego County.  Those who work in San Diego County but DO NOT RESIDE IN SAN DIEGO COUNTY MAY NOT PARTICIPATE in contests on KyXy. Employees of KyXy, its licensee, CBS Radio, their affiliated entities, affiliated advertising agencies, participating sponsors/promotional partners, other radio stations in the San Diego metropolitan area and the members of their immediate families are ineligible to participate or win.

b.   Listeners and members of their household are eligible to win a KyXy contest only once every thirty days and a prize valued at $600 or more only once every six months.  Only one winner per household is permitted in any contest.

 

c. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent.  The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

 

3.  PRIZES:

 

a. Qualifying winners will receive $100 in the form of a check from CBS Corporate.  

 

b. One grand prize will be awarded. It will consist of $1,000.00 in cash, round-trip Towne Car transportation for two (2) to and from San Diego to Los Angeles, two (2) nights accommodations at the Intercontinental Hotel Century City, $50 spa gift certificate, dinner for two at the Park Grill, two (2) tickets to a taping of the Fox Television show “Don’t Forget The Lyrics”, transportation to and from the hotel for the taping, a short “meet-and-greet” with host Wayne Brady. Plus the grand prize winner alone receives a private audition for the chance to be a contestant on Don’t Forget The Lyrics. Decision of show producers is final. Awarding of tickets to Don’t Forget The Lyrics, meet-and-greet with Wayne Brady and private contestant audition are subject to Fox TV’s decision to renew the show for the 2008-2009 season. No replacement prize will be substituted should the show not renew. Trip must be used on dates determined by Fox TV.  Transportation, hotel, dinner & spa courtesy of Kahala Travel.

 

c. Trip vouchers must be picked up at the station within thirty (30) days of winning.  Cash prize will be awarded via U.S. mail within 90 days of winning KyXy’s Finish The Lyrics contest from our parent company, CBS Radio, New York.  KyXy is not responsible for the safe arrival of prize money.  Prior to mailing of prize, winner must provide written consent to mail prize, and therefore, winner assumes the risk of its loss.  The Station is not responsible for the safe arrival of a prize or prize certificate.

 

d. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash.  The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses.  Other restrictions may apply.

 

4.  SELECTION OF WINNERS:

 

a. Decisions of station management with respect to the contest are final.

 

b. Up to three qualifying (3) winners will be selected each weekday:  Thursday, September 18, 2008 through Wednesday, October 15, 2008, between 7:00am & 8:00am, 11:00am & 12 noon and 3:00pm & 4:00pm Pacific Time.  KyXy is not responsible for any telephone malfunction or disconnection, which may result during participation of or during any aspect of this contest.  Decision of KyXy On-Air personality on duty is final.  

 

c. On Monday, October 20, 2008 between 6:00 a.m. & 9:00 a.m. Pacific Time a random drawing will be held live on-air to select a grand prize winner from contest qualifiers. 

 

5.  CONDITIONS:

 

a.   Payment of all federal, state and local taxes is solely the responsibility of the winner.  Winners will be required to sign an IRS Form W-9 or the equivalent.

 

 

b. By participating in the contest, the winner agrees to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and to sign a publicity release confirming such release prior to acceptance of the prize.

c. KyXy, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or who is otherwise in violation of the rules. The station further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including: tampering, unauthorized intervention or technical failures of any sort.

 

d. KyXy reserves the right to make changes in the rules of the contest, including the substitution of a prize or prizes of equivalent or greater value, which will become effective upon announcement.

  e. No purchase is necessary.  The contest is void where prohibited.

 

  f. Failure to comply with the contest rules may result in a contestant's disqualification, at the sole discretion of KyXy.

 

h. KyXy is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.

 

   i.
